William C. Grossman Law, PLLC is the defendant in a proposed class action that claims the business violated the Fair Debt Collection Practices Act by falsely implying that an attorney was involved in the collection of a debt. According to the complaint, the plaintiff received a telephone message from the defendant containing the following sentence: “We have an important message from the Law office of William C. Grossman.” The suit argues that the mention of an attorney or a law office in an attempt to collect a debt is illegal if an attorney was not “directly and personally involved” in the debtor’s account before the message was delivered. The reference to a law office is meant to intimidate the recipient and offer “additional collection leverage” by falsely implying that a law firm is directly involved in the account, the complaint says. “Defendant’s communications,” the suit continues, “were designed to cause the debtor to suffer a harmful disadvantage in charting a course of action in response to Defendant’s collection efforts.”
