A proposed class action filed in Michigan alleges the Law Office of Richelle C. Lester, PLLC ran afoul of federal debt collection laws by failing to advise the plaintiff that a debt collector will assume a debt is valid should no dispute be made the debtor. The case, citing possible Fair Debt Collection Practices Act (FDCPA) violations, further claims the defendant, in a collection notice, asked for payment from the plaintiffs and stated that if the individuals failed to submit payment within 14 days, the law office would file a suit or foreclose on their property. This threat overshadows the plaintiffs’ FDCPA rights, which allow for debt disputes to be made within 30 days of receipt of initial communication from a collector, the lawsuit argues.
