Filed in New York, the suit says the plaintiff received a collection notice in January 2018 in which the defendant identified itself as a law firm that was attempting to collect a debt owed to non-party Cavalry SPV I, LLC. The lawsuit claims the plaintiff was misled as the letter failed to disclose that her account was not personally reviewed by any of the firm’s attorneys.
“Because the Letter states that it is from a law firm, and because the Letter contains no disclaimer as to ‘meaningful attorney involvement,’ the least sophisticated consumer would likely believe that one or more attorneys have been personally involved in the day-to-day collection of Plaintiff’s debt,” the complaint reads.
