Latest Class Action Against Dunkin’ Donuts Claims Products Contain Fake Blueberries

A new class action lawsuit claims Dunkin' Donuts uses fake blueberries in some of its donut and munchkin products.
Another class action hopes to take on Dunkin’ Donuts’ allegedly deceptive business practices, except this case aims right for the company’s bread and butter.
An 18-page complaint filed against Dunkin’ Brands, Inc. in Illinois alleges the company “uniformly” uses imitation blueberries in some of its donuts and munchkins, specifically Dunkin’s “Glazed Blueberry,” “Blueberry Butternut,” and Blueberry Crumb Cake” products. Citing alleged violations of the Illinois Consumer Fraud and Deceptive Business Practices Act, the case claims Dunkin’ Donuts’ false and misleading conduct is likely to deceive consumers because its ostensible imitation blueberries “highly resemble actual blueberries due to their round shape and blue color.”
The case, citing ingredient lists found on Dunkin’ Donuts’ website attached to the complaint as evidence, notes blueberry is not listed as an ingredient for any of the three previously mentioned products. A step further, the plaintiff claims Dunkin’s use of round blue “flavor crystals” is strategic and meant to induce consumers into paying a “premium price” for the allegedly fraudulent donuts and munchkins.
