According to the 15-page lawsuit, the company violated the federal Telephone Consumer Protection Act (TCPA)—which aims to protect individuals from unwanted telemarketing communications—when it repeatedly contacted the plaintiff, an Arkansas resident whose phone number has been on the National Do Not Call Registry since July 2009.
The plaintiff alleges that despite never providing consent to be contacted by the company, he received a total of nine unsolicited text messages from La-Z-Boy or agents acting on its behalf throughout 2023. The man says the telemarketing texts were a “nuisance” and violated his privacy.
“It is simple for companies to avoid calling numbers listed on the National Do-Not-Call Registry,” the suit relays, explaining that La-Z-Boy can easily “scrub” its call list against the national database to identify phone numbers that should be removed. However, the case claims that the defendant and its agents have failed to do so.
As such, recipients of the defendant’s allegedly illegal texts are entitled to at least $500 in damages under the TCPA, the complaint contends.
The lawsuit looks to represent anyone in the United States who, since January 2, 2021, received more than one telemarketing phone call or text message from La-Z-Boy in a 12-month period on their residential landline or cell phone when their phone number had been listed on the National Do Not Call Registry for more than 31 days.
