Stanaszak v. Kohn Law Firm SC et al
Filed: May 1, 2018 ◆§ 2:18cv680
Kohn Law Firm, S.C. and Midland Funding, LLC are on the receiving end of a lawsuit that alleges the companies violated the FDCPA.
Wisconsin
Kohn Law Firm, S.C. and Midland Funding, LLC are on the receiving end of a lawsuit that alleges the companies violated the Fair Debt Collection Practices Act (FDCPA).
The suit says that after filing a lawsuit against the plaintiff, the defendants falsely represented to the court that the man had been properly served with the summons and complaint and allowed a default judgment to be entered against him.
“If the circuit court had known that [the plaintiff] had not been served, or if the court determined that whether Plaintiff had been served was in question, the court would have adjourned the Collection Lawsuit instead of entering judgment,” the complaint argues.
Additionally, the plaintiff claims he didn’t receive any documents from the companies when the judgment against him was vacated.
Lastly, the complaint charges the defendants caused the plaintiff emotional distress when they repeatedly called him at work after the void judgment was vacated.
