Last Updated on May 8, 2018
Joseph v. Kirschenbaum Phillips & Levy, P.C.
Filed: December 27, 2017 ◆§ 1:17cv7533
A consumer's lawsuit outlines claims that Kirschenbaum Phillips & Levy mailed a collection notice that provided few details on 'other charges.'
New York
Kirschenbaum Phillips & Levy, P.C. is the defendant in a proposed class action filed by a plaintiff who claims she received a collection notice in which the company indicated her balance may increase due to unspecified interest or other charges. The case claims the defendant violated the Fair Debt Collection Practices Act (FDCPA) because its supposed failure to provide enough details on what “other charges” may affect the plaintiff’s balance would leave the woman unsure of the minimum amount owed at the time the letter was sent and of how much needs to be paid to resolve the obligation at any point in the future.
