The Kiplinger Washington Editors, Inc. is facing a proposed class action alleging it sent unsolicited fax advertisements in violation of a provision of the Telephone Consumer Protection Act. The plaintiff says he received a fax from the defendant despite never having a business relationship with the company or providing his consent to receive such messages. Further, the fax was supposedly missing a required opt-out notice instructing the plaintiff on how to avoid future faxes.
