Kane County, Utah is the plaintiff in a lawsuit filed against the United States. The suit alleges that counties containing federal lands were under-compensated.
Kane County, Utah is the plaintiff in a proposed class action filed against the United States. The suit alleges that under the Payment in Lieu of Taxes Act, local governments are to be compensated for the loss of tax revenue associated with federal lands located in their counties and the cost of maintaining these lands. The plaintiff claims it did not receive the money it was entitled to in fiscal years 2015 and 2016 because of Congress’ “under-appropriation of funds” during that time. As a result, the plaintiff and other counties with federal lands were forced to pay for the cost of maintaining those lands (including paying for visitors’ emergency services, police protection, waste removal, and road repair), without receiving the total amount of compensation they were legally entitled to claim, the suit says.
