In a proposed class action lawsuit, two consumers allege defendants LendingUSA, LLC, CRB Group, Inc. and Cross River Bank violated the Telephone Consumer Protection Act’s (TCPA) provision preventing the sending of unsolicited junk faxes. The plaintiffs claim they and proposed class members never invited or gave express permission to receive fax messages from the defendants. The case approximates that at least 39 others received unauthorized faxes, which were allegedly sent without proper opt-out language.
