Ignite Payments, LLC is on the receiving end of a proposed class action lawsuit that claims it sent an unsolicited fax advertisement to the plaintiff and other proposed class members. Citing the Junk Fax Prevention Act of 2005, an Amendment of the Telephone Consumer Protection Act of 1991, the suit alleges that the fax advertisements invade the recipients’ privacy and consume their resources. Furthermore, the plaintiff and other proposed class members were unable to avoid receiving the faxes, and the advertisement did not include any language informing them of their right to “opt-out” of receiving future faxes, the complaint says.
