June 2023 Cyberattack Triggers Class Action Against NSC Technologies

The 52-page lawsuit explains that after defendant NSC Holdings, LLC—which does business as NSC Technologies—detected “suspicious activity” in its computer systems, an investigation revealed that an unauthorized third party had gained access to the network and acquired certain stored files between June 19 and 20, 2023.
According to the notice letter sent to victims on November 21 of this year, the data breach compromised the names and Social Security numbers of individuals employed by NSC or one of its subsidiaries, including Anistar Technologies, Consolidated Marine Systems, Nationwide Temporaries, Staffing Resources, Staff Matters, Superior Resource Group and ULG Companies.
The suit alleges that the Atlanta-based staffing agency failed to implement adequate cybersecurity practices to protect employee information, which the case claims was stored unencrypted and unredacted in the company’s system. Per the complaint, NSC also neglected to ensure its IT vendors took appropriate data security measures.
“[The defendant] could have prevented this Data Breach by properly securing and encrypting the files and file servers containing the [personally identifiable information] of [the plaintiff] and Class Members or by exercising due diligence in selecting its IT vendors and properly auditing those vendor’s [sic] security practices,” the filing argues.
Moreover, the lawsuit alleges that the notice letter failed to provide victims with crucial details about the incident, including how cybercriminals gained access to the system and what steps are being taken to secure stored data in the future.
“Without these details, [the plaintiff's] and Class Members’ ability to mitigate the harms resulting from the Data Breach is severely diminished,” the suit says.
Victims like the plaintiff—a Texas resident and former employee of an NSC subsidiary—now face an increased risk of identity theft and fraud as a result of the company’s alleged negligence, the case contends.
The lawsuit looks to represent anyone in the United States whose private information was impacted as a result of the NSC Technologies data breach.
