A New Jersey woman has filed a proposed class action against Jo-Ann Stores, LLC over the company's practice of allegedly sending unwanted text messages to consumers.
A New Jersey woman has filed a proposed class action against Jo-Ann Stores, LLC over the company’s practice of allegedly sending unwanted text messages to consumers’ cell phones in violation of the Telephone Consumer Protection Act (TCPA).
The case notes the plaintiff initially gave the defendant consent to receive automated commercial text messages, which are sent through an automatic telephone dialing system capable of storing and producing phone numbers at random. Despite the plaintiff’s demands that the text messages stop, Jo-Ann allegedly continued to send the texts, claiming that the only way the woman could withdraw her consent was to text “STOP.”
