A proposed class action has been filed against Jefferson Capital Systems LLC after the defendant allegedly attempted to collect a time-barred debt from a Wisconsin consumer without informing him the debt's statute of limitations had expired. According to the lawsuit, the man received a collection notice from the defendant dated May 12, 2017 concerning an alleged obligation owed to Verizon Wireless. The debt at issue had supposedly been in default for more than three years, with the statute of limitations on unpaid cellular service charges capping out at two years. The lawsuit argues that the defendant violated federal debt collection law by neglecting to inform the plaintiff that his debt was unenforceable and couldn’t be collected through litigation.
