A lawsuit presents claims that the baked goods and coffee supplier failed to obtain permission before sending junk fax advertisements to consumers.
Java Joe’s Fundraising LLC and its CEO are the defendants in a proposed class action in which the plaintiff claims the coffee and baked goods supplier sent numerous junk fax messages in violation of the Telephone Consumer Protection Act (TCPA). According to the complaint, the defendants failed to obtain express permission from recipients before sending the advertisements, which the plaintiff claims it received between 2014 and 2015. The case notes the defendants’ supposed junk faxes contained two similar versions of an opt-out notice that both failed to comply with TCPA regulations.
