A proposed class action has been filed by a man who seeks to 'stop the marginalization of blind, vision impaired, and low vision patrons' by Jackson Health System.
A proposed class action lawsuit has been filed in Florida by a man who seeks to “stop the marginalization of blind, vision impaired, and low vision patrons” by defendant Public Health Trust of Miami-Dade County Florida, which does business as Jackson Health System. Citing alleged violations of the Americans with Disabilities Act (ADA), the lawsuit claims Jackson Health System operates its business “in a manner and way that completely excludes” blind and visually impaired individuals, namely by failing to provide auxiliary aides and enhanced communication services on its website portal. The case seeks declaratory damages, as well as injunctive relief for the defendant to correct its policies and procedures to ensure ADA compliance going forward.
The complaint describes the defendant as a collection of medical facilities made up of hospitals, laboratories, specialty clinics, diagnostic centers, rehabilitation facilities, and urgent care/emergency trauma centers. The plaintiff, a legally blind, wheelchair-bound man afflicted with cerebral palsy, maintains that the defendant’s website, jacksonhealth.org, contains numerous access barriers that prevented him from making an appointment.
