An Ohio consumer has filed a proposed class action in Pennsylvania against Ivest 360, LLC and Ivest 360 Syndication Group, Inc., which do business as Fast Capital 360, over alleged violations of the Telephone Consumer Protection Act (TCPA). The plaintiff claims the defendants, in short, called his cell phone for telemarketing purposes without consent using automatic telephone dialing equipment, the use of which is prohibited under the TCPA. The complaint notes that the plaintiff claims the unwanted robocalls began in March 2015 and continued even after the plaintiff added his number to the national Do-Not-Call registry.
