A class action over violations of the junk fax provision of the Telephone Consumer Protection Act (TCPA) has been filed against Innovation Compounding, Inc., a compounding pharmacy headquartered in Georgia. The lawsuit claims the defendant breached the Junk Fax Prevention Act of 2005 by sending out faxes en masse without receiving prior express written permission. Some of the faxes, the suit notes, did not contain TCPA-mandated opt-out language.
