Welch et al v. Ingram & Associates, Inc.
Filed: December 1, 2016 ◆§ 2:16-cv-06642
Ingram & Associates is the defendant in another class action lawsuit claiming the company violated the Fair Debt Collection Practices Act (FDCPA).
Ingram & Associates is the defendant in another class action lawsuit claiming the company violated the Fair Debt Collection Practices Act (FDCPA) by including sets of language in a collection letter to deceive the plaintiff about her rights. According to the complaint, the collection letters sent to the plaintiff were each one sheet of paper with the validation notices written on the back. Under the FDCPA, if a debtor sends a timely written dispute, debt collectors must cease any collection activities until they can obtain verification of the debt. The plaintiff claims the defendant’s letter caused him to be “confused and deceived as to his rights and the defendant’s duties if he made a timely written dispute of the debt.”
