Indochino Named in TCPA Class Action Over Allegedly Unsolicited Robo-Text Messages

Custom menswear retailer Indochino Apparel allegedly sent a consumer at least one unsolicited text message without first obtaining written consent to do so.
Indochino Apparel US is on the receiving end of a proposed class action lawsuit wherein a consumer claims the custom-made menswear company sent unsolicited, automatically generated text messages as part of a telemarketing campaign intended to bolster sales.
The plaintiff behind the complaint claims he received at least one unsolicited, auto-generated text message from the Vancouver clothier in which the company advertised an in-store sale and prompted him to call a phone number to book a fitting appointment. According to the suit, at no time did the plaintiff provide Indochino with express written consent to be contacted by way of an automatic telephone dialing system, the use of which for non-emergency purposes is prohibited under the Telephone Consumer Protection Act (TCPA).
