Illinois Plaintiff Files Two More Class Actions Against Trucking Companies

An Illinois man has filed two more lawsuits against trucking companies who he claims broke the law during the hiring process for prospective drivers.

An Illinois man has filed two more proposed class actions against trucking companies who he claims violated the Fair Credit Report Act (FCRA) with regard to their use of background reports during the job application process for prospective drivers. The lawsuits, filed against Smith Transport, Inc. and Smith Transport U.S.A., Inc. and Precision Motor Transport Group, LLC, respectively, allege the companies, which pull background reports from third-party company HireRight, LLC during their hiring processes, failed to disclose to job applicants, among other items:
- That adverse action, i.e., failure to hire, had been taken against them based solely or partially on information contained in their background report;
- The name, address and phone number of the company that furnished the consumer report;
- That the third-party company that produced the consumer report is not responsible for the decision to take adverse action and cannot provide the applicant with the reason why he or she was not hired; and
- That the job applicant may dispute the accuracy or completeness of his or her background report.
