Van Wyk, Inc. is the defendant in a proposed class action filed by a prospective employee who claims the trucking company decided not to hire him based on information found in his background report without providing him certain disclosures required under the Fair Credit Reporting Act. The plaintiff alleges that he applied for a position as a truck driver at Van Wyk and was told after the company had run a background report on him that he would not be hired. The suit argues that the defendant unlawfully neglected its obligation to, within three days of its adverse decision, inform the plaintiff that he was not hired based on information found in his background report, supply him with the reporting agency's contact information, and notify him that the agency itself did not make the decision to disqualify him from further consideration.
