A New York consumer alleges in a proposed class action that I.C. System, Inc. sent a misleading letter that aimed to “coerce” him into making a payment.
According to the complaint, the September 2017 notice included a settlement offer that was expired by the time the plaintiff received the letter. From the complaint:
“The tender of an illusory settlement is a deceptive means to attempt to coerce a payment from the debtor that would not satisfy the debt.”
In addition, the letter allegedly indicated the man’s account may accrue “additional balances” without providing any explanation of the possible charges. As a result, the letter failed to clearly convey the debt amount, the suit argues.
