A New York consumer claims that I.C. System, Inc. violated the Fair Debt Collection Practices Act (FDCPA) by attempting to charge an unlawful fee for online payments.
A New York consumer claims that I.C. System, Inc. violated the Fair Debt Collection Practices Act (FDCPA) by attempting to charge an unlawful fee for online payments.
The plaintiff alleges that he received a collection letter in September 2018 in which the defendant directed the man to visit the company’s website to make a payment. After following the website’s prompts, the case continues, the plaintiff eventually reached a page before submitting his payment that stated:
“Pay N Seconds™ Convenience Fee $10.01.”
The case argues that under the FDCPA, the defendant was not entitled to collect this amount since the fee was not authorized by the agreement creating the debt or by law.
