A proposed class action out of California claims Hunt & Henriques, Inc. violated the Fair Debt Collection Practices Act (FDCPA).
A proposed class action out of California claims Hunt & Henriques, Inc. violated the Fair Debt Collection Practices Act (FDCPA) by sending a collection letter to the plaintiff illegally requiring that the written dispute of the debt be submitted by mail even though disputes can be submitted on the company’s website. According to the complaint, asking the plaintiff to unnecessarily dispute a debt by mail “is likely to mislead the least sophisticated consumer since said statement places an unnecessary and inappropriate burden on the consumer” to dispute his or her debt while concealing that there are other ways to submit disputes.
