Helvey & Associates, Inc. is on the receiving end of a proposed class action that claims it added an unlawful debt collection fee to a consumer’s account.
Helvey & Associates, Inc. is on the receiving end of a proposed class action that claims it added an unlawful debt collection fee to a consumer’s account. The plaintiff says she received a debt collection letter from the defendant that informed her it would charge a $7.00 “service fee” for payments by credit card.
“The addition of this collection fee by Defendant which was not authorized by the agreement creating the debt or permitted by law, was an attempt to collect an amount not owed by Plaintiff,” the complaint reads, adding that the Fair Debt Collection Practices Act prohibits such actions.
