A lawsuit filed in California federal court alleges that ProOptics sent an unsolicited fax advertisement to an Orange County health care provider.
A proposed class action filed in California federal court alleges that ProOptics LLC sent an unsolicited fax advertisement to an Orange County health care provider.
Pro-Optics, an Illinois-based company, allegedly faxed the plaintiff an unsolicited advertisement for a variety of ophthalmic products, including chin rest paper produced by the defendant.
The suit argues that the defendant violated the Telephone Consumer Protection Act by failing to obtain the plaintiff’s prior express permission to send the advertisement and by not displaying a proper opt-out notice within the fax.
