The 28-page Hatch lawsuit says the rectangular plastic housing of the power adapters that come with the Hatch Baby 1st Generation Sound Machine can come off when the adapter is removed from a power outlet, which can leave the power prongs exposed. The Hatch sound machines at issue were voluntarily recalled in July 2024, with defendant Hatch Baby, Inc. stating that affected devices were primarily sold from 2019 to 2022.
The false advertising lawsuit contends that Hatch failed to notify consumers at the time of purchase, or on product packaging, that the sound machines, intended to provide low background noise to help babies sleep, posed a shock hazard. NBC News reports that Hatch said it received two accounts of consumers receiving “minor electrical shocks” from the product.
According to the complaint, proposed class members who bought a recalled Hatch sound machine now possess a “worthless and dangerous” product. More than 919,000 Hatches sold nationwide were covered by the recall, and Hatch said it received 19 reports of the plastic housing surrounding the AC power adapter having come off, according to the Consumer Product Safety Commission.
“Other manufacturers formulate, produce, and sell non defective [sic] sound machines with formulations and production methods that do not cause the product to shock the user, which is evidence that this shock hazard risk inherent with Defendant’s Products is demonstrably avoidable,” the complaint states.
The filing stresses that consumers “bargained for a sound machine that was safe to use,” yet received an unsafe product with a defective power adapter.
“The Products are not fit for their intended use by humans as they expose consumers to a shock hazard risk,” the suit reiterates.
The lawsuit accuses Hatch Baby of having engaged in “fraudulent, unfair, deceptive, misleading, and/or unlawful conduct” with regard to its alleged omission of the apparent shock risk associated with the sound machines.
No reasonable consumer would have bought the product had they known of the risk of shock, the defective product complaint contends.
The Hatch recall lawsuit looks to cover all United States residents who bought a Hatch Rest 1st Generation Sound Machine between January 2019 and May 2024 with a power adapter bearing the model number CYAP05 050100U.
Hatch Baby has urged consumers to immediately stop using the recalled sound machine power adapters and to contact the company for a free replacement. Hatch has instructed consumers to unplug and cut the power cord on the recalled adapters, then submit photos showing the adapter’s model number and the cut cord on the official recall webpage.
