Hasbro Lawsuit Claims Wizards of the Coast Job Postings Illegally Omit Offered Wage Rates

The 10-page Wizards of the Coast lawsuit claims the trading card and digital game company and parent Hasbro have run afoul of Washington’s Equal Pay and Opportunities Act (EPOA), whose pay transparency provision requires employers of a certain size in the state to disclose in every job posting the wage scale, salary range and a description of all benefits and other compensation a hired applicant will receive.
The plaintiff, a Washington resident who applied for a position with the defendants in May of this year, says he expected to be informed of the job’s pay rate at some point as he progressed through the application. However, the suit contends that the companies did not divulge in the posting or during the application process the position’s wage scale or salary range, as required by law, “forcing [the plaintiff] to complete the entire application without learning the rate of pay.”
The case charges that compliance with the EPOA’s pay transparency provision is particularly important in light of recent research that shows the “pervasive pay disparity” in Washington with regard to women and other protected classes.
According to the complaint, the pay range disclosures mandated by the state’s EPOA are critical to helping job candidates and employees achieve equal pay because the information encourages discussion about wage scales, supports an applicant’s ability to negotiate pay rates, and allows a current employee to learn if they are being underpaid.
The filing alleges that the defendants’ noncompliant job postings have hindered the plaintiff’s ability to accurately evaluate a position’s pay or compare its compensation rate to other available openings in the job market.
The man claims the companies have engaged in discriminatory hiring practices and contributed to wage inequality by failing to comply with Washington’s EPOA.
The Wizards of the Coast job posting lawsuit looks to represent anyone who, since January 1, 2023, applied for a job opening in Washington with the company or Hasbro, Inc., and the job posting did not disclose a wage scale or salary range.
