A proposed class action has been filed against Halsted Financial Services LLC claiming the debt collector improperly demanded payment from a consumer during the 30-day period during which she was permitted to dispute her alleged debt.

A proposed class action has been filed against Halsted Financial Services LLC over alleged Fair Debt Collection Practices Act (FDCPA) violations. The plaintiff in the case says she received a collection letter from the defendant that demanded payment by January 24, 2018, the same date listed at the top of the notice. The suit argues that the defendant’s deadline overshadows the plaintiff’s 30-day validation period, during which she is permitted to dispute her alleged debt or request validation.
“Defendant has demanded Plaintiff make payment during the validation period without explaining that such demand does not override the Plaintiff's right to dispute the debt,” the complaint reads, adding that the debt collector’s notice left the plaintiff “uncertain” and “confused” as to her rights under the FDCPA.
