A proposed class action alleges solar energy companies HahaSmart and Affiliate Solar have misleadingly claimed that their solar panels will help consumers save money.
The 24-page lawsuit says that although HahaSmart and Affiliate advertise that consumers will ultimately save money by purchasing and installing their solar PV systems, this claim is false and misleading since many consumers have in fact lost money on their investment.
The complaint, filed by an Alabama resident on December 9, argues that the companies had a duty to disclose that their solar products would not save buyers money. By neglecting to inform their customers of the truth, the companies “knowingly and intentionally concealed” important details, the case charges.
The marketing practices of HahaSmart and Affiliate are thus “false, misleading, and deceptive,” the lawsuit claims.

Money-saving messages and headings appear prominently on the websites and social media pages of the defendants, the complaint stresses. In particular, phrases like “Go Solar, Start Saving” and “Save money when you go solar with HahaSmart!” directly mislead consumers, the suit contends.
The plaintiff, who bought and installed a solar PV system for $55,000 in January 2021, was assured multiple times by agents of the solar energy companies that the panels on his home would save him money, the case says. The lawsuit alleges that, after signing the agreement, agents at the man’s home made in-person statements that “the system was going to work well at his house and affirmed that he would save money by purchasing and installing the solar PV system.”
According to the complaint, the misleading representations by the solar energy companies were maintained until July of this year, when the plaintiff discovered that he was in fact losing money on the purchase.
The lawsuit claims that the “‘unfair’ and ‘deceptive’ conduct” by HahaSmart and Affiliate has caused consumers such as the plaintiff to buy their solar products when they otherwise would not have.
The lawsuit looks to represent anyone who purchased solar PV systems from HahaSmart or Affiliate Solar during the applicable statute of limitations period and who did not save money on the purchase.
