Gulf Cost Collection Bureau, Inc. has been hit with a proposed class action in Florida over alleged violations of the Fair Debt Collection Practices Act (FDCPA).
Gulf Cost Collection Bureau, Inc. has been hit with a proposed class action in Florida over alleged violations of the Fair Debt Collection Practices Act (FDCPA). The plaintiff says he was sent a collection letter from the defendant that violated the FDCPA because it did not contain certain validation notice requirements. Specifically, the suit alleges that the letter was sent without a written notice containing “a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector.” The suit also notes that the defendants failed to include a written notice informing the plaintiff that he could dispute the debt and that they would obtain verification of the debt or a copy of the judgment and a copy of such would be sent to him.
