Greenspoon Marder P.A. is on the receiving end of a proposed class action lawsuit filed by a New York consumer who claims the defendant sent him a collection letter that failed to comply with the Fair Debt Collection Practices Act.
Greenspoon Marder P.A. is on the receiving end of a proposed class action lawsuit filed by a New York consumer who claims the defendant sent him a collection letter that failed to comply with the Fair Debt Collection Practices Act. The plaintiff alleges he received a notice from Greenspoon Marder containing the following statement:
“As of this writing, the amount owed to AMERICAN CLINICAL SOLUTIONS, LLC is $6,354.49, plus interest.”
The suit argues that this statement is misleading because it failed to provide the plaintiff with enough information to calculate the true amount of his alleged debt “at the time of the notice” or “at any given moment in the future.” The letter, according to the complaint, “must contain an explanation, understandable by the least sophisticated consumer, of any fees or interest that may cause the balance to increase at any time in the future.”
