Grand Caribbean Cruises Hit with Class Action Over Alleged Robocalls

A proposed class action lawsuit claims Grand Caribbean Cruises, Inc. has placed unlawful robocalls to consumers’ cell phones without obtaining their prior express consent to be contacted.
The nine-page case, which was recently removed from state to federal court in Florida, claims Grand Caribbean’s calls have violated the Telephone Consumer Protection Act (TCPA), a federal law that prohibits the use of an artificial or prerecorded voice to place non-emergency telemarketing calls to consumers’ cell phones without their prior express consent.
“The TCPA exists to prevent communications like the ones described within this Complaint,” the lawsuit scathes.
The plaintiff claims to have received a call from Grand Caribbean in January 2021 and was “easily able to determine that it was prerecorded.” Per the case, the call constituted telemarketing given the message contained a solicitation urging the plaintiff to book a “Bahamas Dream Cruise” through Grand Caribbean.
According to the filing, the plaintiff never provided her prior express written consent to be contacted by the defendant on her cell phone with a prerecorded voice message. The plaintiff claims she and “thousands of individuals” have experienced invasion of privacy, harassment, aggravation and disruption of their daily lives as a result of Grand Caribbean’s actions.
The lawsuit looks to represent anyone in the U.S. who, within the past four years, received a prerecorded voice call to their cell phone from the defendant, or anyone on its behalf, promoting or advertising Grand Caribbean’s goods and services.
