A lawsuit claims that job placement services provider GoSmith texted a Miami resident without first obtaining the man’s express consent to do so.
GoSmith, Inc. is the defendant in a proposed class action out of Florida that alleges the job placement services provider texted a Miami resident without first obtaining the man’s express consent to do so.
Between March 2018 and the following August, the defendant sent several automated texts to the plaintiff’s cell phone in which the company advertised its app and promoted job openings, according to the suit. The case claims that GoSmith violated the Telephone Consumer Protection Act (TCPA) by contacting the man using an automatic telephone dialing system without his prior express permission. Additionally, the plaintiff alleges he attempted to opt out of further messages in April 2018 yet went on to receive at least 10 more unauthorized texts.
