Gorss Motels, Inc. is the plaintiff in another class action lawsuit filed over reported Telephone Consumer Protection Act (TCPA) violations. Filed in Connecticut against Schneider Publishing Company, the lawsuit claims the defendant breached the Junk Fax Prevention Act of 2005 by sending out unsolicited junk advertisement faxes that did not contain TCPA-required opt out language. Without this opt out language, the suit claims, “there is no reasonable means for [the plaintiff] (or any other class member) to avoid receiving unauthorized faxes.”
The proposed class covers anyone who was sent an advertisement fax from Schneider Publishing Company within the last four years without first giving express permission and that did not contain mandatory opt-out language.
