Goodman’s Sales, LLC finds itself as the defendant in a proposed class action case in which the plaintiff claims the appliance retailer and repairer sent out unsolicited marketing text messages in violation of the Telephone Consumer Protection Act (TCPA). The plaintiff, a Florida resident, claims he received a text from the defendant in October 2017 advertising Goodman’s “specials for this weekend” despite never providing express written consent to be contacted. The suit further claims the defendant sent the alleged texts using automatic dialing technology capable of sending short-coded text messages to many consumers at once.
