Another proposed class action alleges the Hertz Corporation breached the terms and conditions of its Gold Plus Program by charging excessive administration fees.
Piggybacking onto a case filed back in October 2016, another proposed class action alleges the Hertz Corporation breached the terms and conditions of its Gold Plus Program by charging members excessive administrative fees for each time they passed through a toll booth without paying the toll.
Under Hertz’s Gold Plus Program, members must repay the company for “all its related collection and other expenses, including an administrative fee” for the cost of collection or for costs related to “providing information about [renters] to a court or governmental agency” for parking and traffic violations, the lawsuit says. The terms and conditions of the program, the case continues, do not permit Hertz to charge Gold Plus members fees that exceed the amount necessary to reimburse the defendant for toll expenses.
The plaintiffs argue the fees Hertz charges Gold Plus members, which the case says are sometimes called “violation-handling fees,” should only amount to “pennies per transaction,” far less than the $30 Hertz allegedly charges for each unpaid toll violation.
