Goji, Inc. has been hit with a proposed class action that alleges the insurance agency violated the Telephone Consumer Protection Act by placing unwanted telemarketing calls to consumers’ cell phones without their permission.
Goji, Inc. has been hit with a proposed class action that alleges the insurance agency violated the Telephone Consumer Protection Act by placing unwanted telemarketing calls to consumers’ cell phones without their permission. According to the lawsuit, the defendant used automated technology to dial the plaintiffs’ phone numbers in an attempt to sell them insurance despite never having a business relationship with the individuals nor obtaining their express written consent to receive the calls. Further, the plaintiffs claim their respective phone numbers had been listed on the National Do Not Call Registry for at least several years before they began receiving the company’s robocalls.
The first plaintiff says the defendant called her “dozens of times” and continued calling even after she demanded to be placed on the company’s internal do-not-call list. Similarly, the second plaintiff claims he received at least 25 unwanted calls during a 12-month period, causing him “extreme aggravation.”
