GM Ends October with Another Class Action, This Time Over Alleged Corvette Z06 Overheating

The latest lawsuit against GM claims certain 'track-proven' Corvette Z06 models are prone to overheating, which sends the cars into low-powered 'Limp Mode.'
The month of October has been rough for General Motors, as the company once again finds itself as the defendant in a proposed class action lawsuit over alleged defects found in its vehicles.
Filed on October 30 in Illinois, the lawsuit alleges GM misled customers about its 2015, 2016 and 2017 Corvette Z06 vehicles. According to the complaint, although GM touted the vehicles as “track-proven” and able to withstand the stresses of track racing, the cars are prone to overheat and go into “Limp Mode,” which the case describes as a condition in which the vehicles operate at drastically reduced speed and power. From the lawsuit (emphasis ours):
“There are certain basic rules that all carmakers must follow. When a carmaker sells a car, it has a duty to ensure that the car functions properly and safely for its advertised use and free from defects. When a carmaker discovers a defect, it must disclose the defect and make it right or cease selling the car. And when a carmaker provides a warranty, it must stand by that warranty. This case arises from GM’s breach of these rules. GM deceived its customers when it sold or leased the Z06s while promising that they were built for the track, when in fact they were unreliable and unsafe for that purpose.”
The plaintiff alleges the supposedly defective cooling systems in Corvette Z06 models make the cars unreliable and unsafe, particularly for customers who use the vehicles on racing tracks where the cars can reportedly go into “limp mode” due to the powertrain overheating. The powertrain cooling defect can also manifest in non-track driving conditions too, the case says, adding that the engines in Corvette Z06s can overheat to such high temperatures that they can become warped.
The case argues GM is aware of the Corvette Z06 cooling system defect and even suspended production of the cars for a while. The supposed remedy to the problem, the lawsuit says, only applies to 2017 model vehicles and does not help consumers with older Z06s.
