In what's becoming the norm for Wells Fargo, another proposed class action has been filed against the bank claiming it violated the Telephone Consumer Protection Act.
In what’s becoming the norm for Wells Fargo, another proposed class action has been filed against the bank claiming it violated the Telephone Consumer Protection Act (TCPA) by calling consumers’ cell phones without permission. The Gwinnett County, Georgia man who filed the case claims Wells Fargo used an automatic telephone dialing system to contact him about an allegedly past-due or delinquent account or to solicit him into opening a new account. Even when the plaintiff expressed to a human operator on the other end of the call that he wished for the calls to stop, he was told his options were very limited, the suit claims.
“On or around September of 2014 as part of its dialing campaign, Wells Fargo initiated a call to [the plaintiff] during which [the plaintiff] expressed that he wished the calls to his cellular telephone to cease; the representative in response instructed [the plaintiff] that the only way for the calls to stop complete was to bring the account current,” the complaint claims.
