Genpact Services LLC is at the center of a class action lawsuit alleging the agency sent collection letters to the plaintiffs that did not meet statutory guidelines set forth by the Fair Debt Collection Practices Act (FDCPA). Filed in the Eastern District of New York, the suit claims Genpact’s communications with the plaintiffs did not include “safe harbor” language—essentially a promise that certain conduct will be within the boundaries of a law—regarding the accrual of interest and/or fees. Plaintiffs also allege that, in addition to not including itemized debts as required by the FDCPA, the letters from Genpact failed to clearly note that if the debtors pay their balances “as of the date of the letters,” an adjustment to the total owed may be necessary later on. The class includes individuals in New York from whom the defendant tried to collected a debt using the same letters sent to the plaintiffs from one year before the date the suit was filed.
