Genpact Services LLC has been hit with another proposed class action [link] this week alleging Fair Debt Collection Practices Act (FDCPA) violations.
Genpact Services LLC has been hit with another proposed class action this week alleging Fair Debt Collection Practices Act (FDCPA) violations. The plaintiff, a New York man, claims he received a letter from the defendant specifying a “Balance Due” and indicating that the balance “may increase because of interest or other charges.” The complaint argues, however, that the letter contains no mention of the interest rate, when the interest will be calculated, the nature of the “other charges,” or any other information that would allow the plaintiff to accurately calculate how much he needs to pay. As a result, the suit continues, the letter violates the FDCPA, which requires that debt collectors clearly communicate the amount of consumers’ alleged debts.
