In a proposed class action lawsuit, Genpact Services LLC is facing claims that it violated federal law by failing to accurately communicate the true amount of a consumer’s alleged debt.
In a proposed class action lawsuit, Genpact Services LLC is facing claims that it violated federal law by failing to accurately communicate the true amount of a consumer’s alleged debt. The plaintiff says she received a collection letter from the defendant that stated the following:
“The total account balance as of the date of this letter is shown above. Your account balance may increase because of interest or other charges, if so provided in your agreement with your creditor.”
By indicating that the account balance “may increase” without providing specific information regarding interest or other charges, the letter violates the Fair Debt Collection Practices Act, the suit says, because it leaves the plaintiff unable to determine the true amount of the alleged debt. “The Defendant’s failures are purposeful,” the complaint argues, claiming the ambiguity in the letter was meant to “induce payments from consumers that would not otherwise be made if the consumer knew the true amount due.”
