From Wisconsin federal court comes a proposed class action filed against Genpact Services, LLC over the defendant’s alleged failure to adhere to debt collection law.
The case is centered around an alleged debt associated with a woman’s “TJX Rewards” credit card owned by Synchrony Bank. According to the lawsuit, the bank sent the plaintiff an account statement followed by a notice a few days later that respectively identified her “amount past due” and “amount now due” as $85.00. About a month after the notice was sent, the plaintiff supposedly received another account statement indicating that her “amount past due” had increased to $154.00 and that her “total minimum payment due” was equal to $229.00.
The case claims Genpact then sent the woman a collection letter demanding that she pay an “amount now due” of $229.00. The suit argues that the debt collector misleadingly sought the plaintiff’s minimum payment amount from her account statement rather than the “amount past due.” According to the complaint, the minimum payment was not yet due at the time the letter was sent, and the debt collector used the creditor’s language – “amount now due” – to deceive the plaintiff into thinking she owed the full minimum payment instead of the lesser amount noted in her account statement.
