Genpact Services LLC is on the receiving end of a proposed class action lawsuit filed by a Wisconsin woman who claims the debt collector misled her as to the minimum payment she owed on her alleged debt.
Genpact Services LLC is on the receiving end of a proposed class action lawsuit filed by a Wisconsin woman who claims the debt collector misled her as to the minimum payment she owed on her alleged debt. According to the suit, Synchrony Bank sent the plaintiff a credit card statement that listed an “amount past due” and a “total minimum payment due,” among other itemizations. After she received the statement, the complaint says the defendant sent her a collection letter regarding her credit card account that referred to the statement’s “amount past due” as the “amount now due.”
In September 2017, the plaintiff’s credit card statement allegedly indicated that her “amount past due” totaled $110.00 and her “total minimum payment due” totaled $160.00. According to the suit, she then received a collection letter from the defendant demanding an “amount now due” of $160.00. The suit argues that the defendant misrepresented the plaintiff’s true balance and was attempting to collect what her creditor had referred to as the “total minimum payment” – a portion of the plaintiff’s alleged debt that was not due until a future date listed on her statement. From the complaint:
“Upon information and belief, the purpose of Genpact’s conduct –attempting to collect the ‘Total Minimum Payment Due’ rather than the ‘Amount Past Due’ – is to increase its profits under false pretenses.”
The case argues that the debt collector misled the plaintiff as to how much money she needed to pay to “bring her account current” and attempted to make a profit by collecting money “owed” to Synchrony but “not yet due.”
