Gavaldon v. General Motors Company et al
Filed: March 26, 2018 ◆§ 2:18cv10958
Eight vehicle models are mentioned in a class action filed against General Motors over an alleged air conditioning system defect.
New Mexico
General Motors Company, General Motors Holdings, LLC and General Motors, LLC are listed as defendants in another proposed class action filed over a supposed air conditioning system defect afflicting the below vehicle models:
- 2015-2017 Cadillac Escalade and Escalade ESV;
- 2015-2017 Chevrolet Suburban;
- 2015-2017 GMC Yukon and Yukon XL;
- 2015-2017 Chevrolet Tahoe;
- 2014-2017 GMC Sierra 1500;
- 2015-2016 GMC Sierra Heavy Duty;
- 2014-2017 Chevrolet Silverado 1500; and
- 2015-2016 Chevrolet Silverado Heavy Duty.
The lawsuit charges that the defendants not only designed, manufactured, sold and marketed the above vehicles containing the alleged defect, but had knowledge of the problem and failed to alert prospective customers and current owners and lessees.
Per the plaintiff’s alleged experience, the case says he began noticing problems with his 2015 Sierra’s air conditioning system less than two years after he purchased the pickup. The man claims that for weeks he continually had to re-charge the system with refrigerant. When he took his truck to a dealer, the complaint says, the plaintiff was advised he needed a new condenser that would cost more than $1,000 to replace given that his vehicle was out of warranty. The lawsuit says the plaintiff resorted to buying a new condenser and replacing the part himself.
