A lawsuit claims the energy efficiency company made unsolicited robocalls to consumers as part of a wide-scale telemarketing campaign.
Three plaintiffs have put their names on a proposed class action filed over defendant GDFriend, Inc.’s alleged practice of placing unsolicited robocalls to consumers’ cell phones, even to numbers included in the national Do Not Call registry. The defendant, an energy efficiency company that sells home improvement products, violated the Telephone Consumer Protection Act (TCPA) by using automatic dialing technology to, as part of a wide-scale telemarketing campaign, call consumers with whom the company had no established business relationship, the plaintiffs say. The lawsuit claims that even when proposed class members attempted to opt out of receiving the calls, GDFriend—which the case says does business under the names Direct Home Energy Solutions, Green Home Investment Program and Powerstar Home Energy Solutions—continued to call them.
