A proposed class action has been filed against GC Services Limited Partnership and ORG GC GP Buyer, LLC over claims that the debt collectors falsely implied a consumer’s debt was subject to interest.

A proposed class action has been filed against GC Services Limited Partnership and ORG GC GP Buyer, LLC over claims that the debt collectors falsely implied a consumer’s debt was subject to interest. According to the complaint, the plaintiff received a collection letter from the defendants regarding a charged off Macy’s/Department Stores National Bank account. The letter allegedly warned her that the account was subject to “interest, late charges, and other fees” that could cause the balance to increase in the future. In reality, the case argues, the plaintiff’s account was charged off and, as a matter of policy, was not accruing added fees. The letter, therefore, was a “false, deceptive or misleading representation” and attempted to falsely threaten the plaintiff into paying off her debt sooner, the suit suggests.
