A proposed class action has been filed against GC Services Limited Partnership claiming the debt collector falsely implied that the plaintiff’s debt balance was increasing and that she would benefit by paying it off sooner.

A proposed class action has been filed against GC Services Limited Partnership claiming the debt collector falsely implied that the plaintiff’s debt balance was increasing and that she would benefit by paying it off sooner. According to the complaint, the defendant sent the woman a collection notice stating she owed a “new balance” of $852.57 and indicating that the amount “may vary from day to day” due to “interest, late charges, and other charges.” The case argues that the plaintiff’s account was not, in fact, subject to interest or additional fees and would never increase, despite the defendant’s supposed implications. The language in the letter, the lawsuit poses, was “merely a deceptive collection tactic” meant to induce payment from the plaintiff.
